Terms of use

In order to use OÜ LaFiesta in Estonia, registration number 16334588, (hereinafter referred to as the Seller) on the website of the online store www.lafiesta.ee and/or make purchases there, please read and accept the following terms and conditions of the online store offered by the Seller (hereinafter referred to as the Terms):

1. General Provisions

1.1. In accordance with these Terms and Conditions, OÜ LaFiesta in Estonia (hereinafter referred to as the Seller) sells the goods posted on the website of the Seller’s online store, SARASA, Bras del Port, Mitjans, Eutiquio, Nines de
Onill, Martiko, Lorusso, Marquez de Vizhoja, Cafe Ambrosiano, La Rustichella, Patatas Rubio, Comex Bakery, Gourmet Cazorla, Entrepinares, Dani, Turrones Vicente, Hacendado, Deliplus, Vitim, MediPeel, Masil, Valentina Snaks (hereinafter referred to as the Goods).

1.2. The Rules apply to legal relations arising in connection with the purchase of Goods in the Online Store between the Buyer (hereinafter referred to as the Buyer) and the owner of the purchasing environment (hereinafter referred to as the Online Store) at the Internet address www.lafiesta.ee – the Seller.
Legal relations arising from the purchase of Goods in the online store www.lafiesta.ee, in addition to these rules, are also regulated by the current legislation of the Republic of Estonia.

1.3. The Seller has the right to change the terms of use of the online store or the prices of goods and services.
The Seller informs the Buyer of changes on the website www.lafiesta.ee. The terms and prices valid at the time of the transaction apply to the transaction.

2. Placing and Receiving an Order

2.1. By placing an order in the Online Store, the Buyer confirms that he/she has read the description of the selected product and/or service and that it meets the requirements and needs set by the Buyer.

2.2. The Buyer undertakes to provide accurate personal data necessary to ensure the order, the order delivery address and contact information at the time of placing the order.
In case of inaccurate data,
the order cannot be ensured.

3. Price and payment procedure

3.1. The prices of goods and services in the Online Store are indicated inclusive of taxes, including value added tax.
The fee for order delivery (if any) is determined separately depending on the
cost of delivery in the Online Store.
3.2. By confirming the order, the Buyer agrees to pay the current price.
3.4. You can pay for your order using the links of the commercial banks of the Republic of Estonia SEB, Luminor, COOP, Swedbank and a bank payment card (Visa, MasterCard).
3.5. Payment is made outside the online store by bank transfer.
3.6. The Seller does not have access to the Buyer’s bank details and credit card details.

4. Products

4.1. Products listed in the online store are usually available in the warehouse or in the seller’s stores.
The availability of these Products is not guaranteed, as they may be misleading due to
possible technical problems with the programs.
4.2. If the Buyer places an order, but it turns out that the Product is not in the Seller’s warehouse and the Online Store cannot fulfill the order, the full purchase amount is returned to the Buyer.
4.3. The photographs of the Product posted in the online store www.lafiesta.ee are illustrative and may differ slightly from the actual appearance of the Product.

5. Ordering a Product

5.1. To make a purchase of a Product, the Buyer, who has registered in the online store and agreed to these terms, selects the desired Product in the online store and adds it to the basket by
clicking the “Add to basket” button.

5.2. To place an order, the Buyer must do the following:
5.2.1 You must select the product or products by adding them to the “Basket”.
5.2.2. Having placed all the selected products in the “Basket”, click the “For
payment” button. The Buyer is redirected to the order page.
5.2.3. After entering the required data and checking the correctness of the data, the Buyer confirms the order by clicking the “Confirm and pay” button. After this step, the order is confirmed and sent to the seller.
5.2.4. The Buyer pays for the Product by bank transfer.
5.2.5. After payment for the Product, the Online Store sends an order confirmation to the email address specified by the Buyer.
5.3. The Buyer undertakes to provide accurate personal data necessary to ensure the Order, the Order delivery address and contact information when placing the Order.
In case of inaccurate data, the Order cannot be protected.
5.4. The Seller shall not be liable for the impossibility of fulfilling the order and for any consequences arising from the data provided by the Buyer, but incorrect.
5.5. The Seller has the right to refuse to fulfill the Order.
when completing an order, if there are doubts about the accuracy of the data provided to the Seller, as well as in the event of actions that do not comply with generally accepted principles.

6. Delivery

6.1. The Buyer can choose between different methods of delivery of the product.
Delivery of the product depends on the postal service selected by the Buyer.
6.2. When choosing the Omniva parcel delivery method, the Product will arrive at the parcel terminal selected by the Buyer within 5 working days after sending the order confirmation to the Buyer’s email address.
The Buyer is informed about the delivery of the parcel via text message.

Parcels are opened for 24 hours.
The product is stored in the parcel terminal for 7 calendar days.
After the specified period, the Product is sent back to the Online Store.
If the Buyer does not delete the Product within the above period, the Buyer is obliged to reimburse the costs associated with re-sending the Product.
6.3. If the Buyer places an order on a weekend (from Friday after 13:00 to Monday at 09:00) or on a public holiday, the 5-day period begins on the first working day following the weekend or public holiday, starting at 09:00.
6.4 Before placing an order, the Buyer is obliged to check the correctness of the contact information that will be provided in order to avoid delays and uncertainties in the delivery of the Product.
The Seller is not liable for delays and uncertainties in the delivery of the Product if the reason for the delay or uncertainty is the inaccuracy or inaccuracy of the data provided by the Buyer during the execution of the order.
6.5. If the Product does not reach the Buyer in good condition and in unopened packaging, the Buyer is obliged to notify the Online Store by sending a corresponding letter to the e-mail address: info@lafiesta.ee or by calling +372 55502252.

7. Return and replacement of an order

7.1. The Buyer has the right to exercise the right of withdrawal within 14 (fourteen) days from the date of delivery of the Order by filling in a notice of exercise of the right of withdrawal and submitting it to the relevant seller as a written confirmation of refusal of the Order.
7.2. To return/replace the goods, the return application must be submitted to the Seller within 14 days from the date of receipt of the goods.
The return application can be submitted as follows:
7.2.1. By sending the completed return form to the Seller together with the returned goods via the Omniva parcel terminal.
7.2.2. Goods returned to the Seller are accepted only together with a completed return form or application.
The return form can be obtained by e-mail by requesting it at info@lafiesta.ee
7.3. The consumer must return the goods within 14 days from the date of the application or from the moment when he handed over the goods to the logistics company during the above period.
The Seller has the right not to refund the money until he receives the subject of the contract (Product) or until the Buyer provides evidence that he has returned the object, depending on which comes first.
7.4. The product to be exchanged or returned must not show signs of damage or wear, the Product must be in the original packaging, the Product must have all the original labels.
If the condition of the returned item has deteriorated, the Buyer is liable for the loss of value of the item as a result of using the item only if he used the item in a way other than that necessary to verify the nature, characteristics and functionality of the item.
In order to clarify the nature, characteristics and functionality of the product, the Buyer must handle and use the product only as is usually allowed in stores.
7.5. Underwear, cosmetics and perfumes in open packaging are not subject to return.
7.6. The Buyer must always carefully open the Product packaging without damaging it. If the packaging cannot be opened without damaging it, the Product does not need to be returned in the original packaging.
7.7. If the Omniva parcel terminal was selected as the delivery method, the Order can be exchanged or returned via the Omniva parcel terminal using the return code in the original SMS notification. to

8. Procedure for filing claims

8.1. The period for filing claims specified in Section 218(2) of the Law of Obligations applies to the goods sold.
8.2. In case of non-compliance with the requirements of the product or defects, the Buyer undertakes to notify the Seller immediately, but not later than within 2 months from the date of detection of the defect, by sending the buyer’s contact information, an exact description of the non-compliance and defect and the purchase receipt number to the e-mail address info@lafiesta.ee If defects are detected in the Product, the Buyer must immediately
stop using the Product.
8.3. All claims are considered and the Seller will contact the Buyer as soon as possible sti, but not later than within 15 days from the date of receipt of the claim.
8.4. The Seller shall not be liable for damages caused by improper use of the ordered goods, as well as for delays in delivery, if this was caused by circumstances beyond the control of the
Seller, and / or caused by force majeure circumstances beyond its control.
8.5. The Seller shall not reimburse the expenses incurred by the Buyer if the Goods do not meet the requirements, or the Goods are faulty and shall not be liable if: the value of the Goods has decreased, the Goods have been damaged due to the fault of the Buyer, the damage has arisen due to improper use, incl.
due to failure to comply with maintenance instructions the value of the Product has decreased due to natural wear and tear, as a result of normal use or lack of proof of purchase.

9. Liability

9.1. The Seller and the Buyer are liable for damage caused to the other party as a result of failure to comply with these Terms of Use in the cases and to the extent specified in the current legislation of the Republic of Estonia.
9.2. The Seller is liable for the selling price of the Product.
9.3 The Buyer undertakes to use the services of the Online Store only for purposes that comply with the law and regulations.

10. Protection of personal data

10.1. Personal data provided by buyers are processed in accordance with the requirements of the Personal Data Protection Act and the requirements of other EU and Estonian regulations governing the processing and protection of personal data.
When processing and storing the Buyer’s personal data, the Seller uses organizational and technical means to ensure the protection of personal data from accidental or illegal disclosure, modification, as well as from any other illegal processing.
Cookies may be used in the Seller’s online store.
10.2. The Buyer agrees to the processing of their personal data specified during registration, ordering and/or received through the Online Store, for the purpose of fulfilling the order (contract), including
transfer to third parties for delivery, payment processing, databases and statistics of the buyer, as well as to determine the creditworthiness of the buyer and the ability to fulfill payment obligations.
10.3. The Seller has the right to transfer to third parties the right to collect the debt arising from the purchase, if any, on the buyer’s debt for collection purposes, which also includes the right to use the buyer’s personal data to create a credit history of the buyer and enter the buyer’s data into the databases of the debt and credit bureau.

10.4. The Buyer agrees that the Seller processes the Buyer’s personal data.
10.5. The personal data received by the Seller are registered in the Register of Buyers and are used to provide sales services and offer goods to the Buyer.
10.6. The Seller stores the Buyer’s contact information, which the Buyer entered when making a purchase, as well as information about purchases made by the Buyer.
This information is considered confidential and is processed in accordance with the Law on the Protection of Personal Data.
Personal data required to send the Goods to the Buyer are sent to the company providing courier services.
10.7. By registering or making purchases in the Online Store, the Buyer agrees to receive commercial notifications from the Seller to the e-mail address provided by the Buyer and text messages to the mobile phone number, including goods delivered by the Seller.
To unsubscribe from receiving commercial text messages, the Buyer can use the appropriate link on the website of the Online Store.
10.8. Data transfer between the Buyer and banks and the payment card center is encrypted, which ensures the security of the Buyer’s personal data and banking data.
Payment is made outside the environment of the
Online Store, in the secure payment environment of the relevant bank or service provider.
The Online Store does not have access to the Buyer’s banking data and credit card data.
10.9. Personal data is processed by OÜ LaFiesta in Estonia.

11. Terms of Use and Amendments

11.1. By registering or making purchases in the Online Store, the Buyer agrees to the terms of use of the Online Store and undertakes to comply with them.

11.2. The purchase and sale agreement between the Seller and the Buyer comes into force from the moment the purchase amount to be paid is received in the Seller’s current account.

11.3. The Seller has the right to change the terms of use of the Online Store and change the prices of the Products.
Information about the changes is published in the Online Store environment.
The terms and prices valid at the time of the transaction apply to the transaction.

11.4. The Seller has the right to refuse to fulfill the order if, due to a technical error, an incorrect price for the Product was displayed in the Online Store.

12. Other provisions

12.1. Disputes between the Buyer and the Seller shall be resolved are resolved through negotiations.
12.2. If the Seller refuses to resolve the Buyer’s complaint or the Buyer does not agree with the solution proposed by the Seller and believes that his/her rights have been violated, the Buyer has the right to file a complaint with the
Consumer Complaints Committee through the Consumer Protection Service.
